3. Eligibility

Users must:

  • Provide accurate and truthful information during registration.

  • Users are prohibited from:

5. Responsibilities

  • For Clinics and Healthcare Professionals:
    • Ensure compliance with Kenyan laws, including the Data Protection Act, 2019 and the Health Act, 2017.
    • Maintain the confidentiality of patient data.
  • For Patients:
    • Provide accurate health information to ensure quality care.

6. Fees and Payment

  • Subscription fees apply for access to SMART CLINIC.
  • Payments must be made in full and on time.
  • Refunds, if applicable, will follow the refund policy outlined on the platform.

7. Intellectual Property

  • All content, software, and trademarks on SMART CLINIC are owned by or licensed to SMART CLINIC.
  • Users may not reproduce, modify, or distribute content without prior written consent.

8. Limitation of Liability

  • SMART CLINIC is provided "as-is" without warranties of any kind.
  • We are not liable for:
    • Losses due to misuse of the platform.
    • Interruptions or delays in service.
    • Data breaches caused by unauthorized access to user accounts.

9. Termination

  • SMART CLINIC reserves the right to terminate accounts for breach of these Terms and Conditions.
  • Users may terminate their accounts by contacting customer support.

10. Privacy

SMART CLINIC’s use of your data is governed by our Privacy Policy, which complies with the Kenyan Data Protection Act, 2019.

11. Dispute Resolution

  • Any disputes arising from these Terms shall be resolved through mediation under Kenyan law.
